Notices – Licensing Updates

Members of the NCITLB are pleased to announce that efforts to amend the Interpreter and Transliterator Licensure Act, General Statute 90D, have been successful. Legislation, first known as HB (House Bill) 1507, has been ratified and was signed into law by Governor Mike Easley on August 22, 2005. The legislation is now known as SL (Session Law) 2005-299, ”AN ACT TO AMEND CERTAIN LAWS UNDER THE NORTH CAROLINA INTERPRETER AND TRANSLITERATOR LICENSURE ACT, TO EXPAND THE GROUP OF PERSONS WHO MAY OBTAIN A PROVISIONAL LICENSE UNDER THE ACT, AND TO AUTHORIZE THE NORTH CAROLINA INTERPRETER AND TRANSLITERATOR LICENSING BOARD TO ASSESS CIVIL PENALTIES”.

The amended law provides opportunities for more people to be eligible for a provisional license. This will benefit professional interpreters and transliterators as well as our consumers because it expands the potential interpreter base. The amended law also allows out-of-state interpreters to work in the state of North Carolina without a license for a limited period of time (20 days), which will minimize the impact on interpreting services across the state when we have a large conference that requires interpreters (SERID being a prime example of that), and it gives the Board more authority. The Licensure Board can now impose civil fines on people who break the law, such as by charging a fee for performing interpreting services without a license.

These amendments to the Law were a direct result of input we received from individuals and organizations across North Carolina obtained through the various public meetings held throughout the state, via e-mail, letters and phone calls. This information, coupled with the issues that were identified by the Board as we went through the rules making process, was the backbone of the recommendations we made to the Legislature. We feel we now have a more effective law, one that adds more interpreters into the licensing process, gives us some relief during peak interpreter demand periods, and gives the Board some clout when it comes to dealing with those who choose not to adhere to the law.

Rulemaking Notice:

The Board has initiated rulemaking under the North Carolina Administrative Procedure Act. The Board proposes to amend its rules in order to comply with a new North Carolina law, S.L. 2009-458. This law requires all occupational licensing boards to adopt rules to postpone or waive continuing education requirements and license renewal fees for any individual who is currently licensed by the board and serving in the United States armed forces in a combat zone.
